GREENVILLE - A 20-year-old Union City man is on his was to Orient, Ohio to begin serving a six-year prison sentence for having sex with a minor.

Codey Michael B. Greer accepted a plea agreement in November by pleading guilty to three counts of Sexual Battery, felonies of the second degree, after being indicted in September on three counts of Rape. After a pre-sentence investigation Darke County Common Pleas Court Judge Jonathan P. Hein handed down the six-year sentence with 131 days of jail credit at a sentencing hearing Wednesday.

Greer was charged after an investigation revealed that when he was 18 when he engaged in three separate sexual acts within a 24-hour period with a 12-year-old girl.

According to Greer’s defense attorney Randall E. Breaden, the girl allegedly lied about her age when contacting Greer on Facebook.

“Though we do not condone this type of behavior, the offense occurred during a 24-hour period and was not ongoing conduct,” Breaden stated prior to sentencing.

“I am not saying the girl is blameless, but with her only being 12 years of age, he should have been the responsible party and discouraged any contact that was initiated by her,” stated Darke County Prosecuting Attorney Kelly Ormsby. “At the minimum the defendant was reckless in his behavior and if the girl was 12 or 13 was not important to him at the time.”

“Prison is not going to spoon feed you job skills and education,” Judge Hein told Greer during Wednesday’s sentencing. “You will only get something out it if you want to. You can have a long life of being productive if you work at it while you are there.”

Greer will be placed on post release control for up to 60 months after completing the prison sentence.
