Alleged rapist’s trial moved to October

GREENVILLE — Ciro Rivera, 42, of Greenville, filed for a continuance on his case. Judge Travis L. Fliehman presided.

Rivera is on trial in the Court of Darke County Common Pleas for an alleged rape, a felony of the first degree. On July 26, following his bond hearing, Rivera’s defense attorney, David Rohrer, filed a motion for continuance on his client’s behalf. The trial was originally set for July 30 and 31.

“Plaintiff, through undersigned counsel, requests to continue his trial date so that he can review the State’s recent offer with his Immigration Attorney in Cincinnati to discuss the effect of the State’s offer on his immigration status,” the motion read.

Rivera is currently on electronic house monitoring with ICE, and he understands this request tolls his speedy trial rights. This motion to continue has also been agreed to by the State’s Assistant Prosecuting Attorney Deborah Quigley.

The Court found the motion well taken and deemed it granted. It was ordered, adjusted, and decreed that that trial be reassigned for Oct. 29 at 9 a.m.
